Нет данных о номере 40 дней

Всем привет, ситуация такая:

Продавец отправил посылку 40 дней назад и дал мне трек-номер, но все 40 дней об этом номере никаких упоминаний (в любой проверочной системе пишит, что номер не найден). Говорит, что сам не знает что с посылкой и просит быть терпеливее. Можно ли уже открывать спор?
